Prices & Availability:  Please quote Price List date when ordering as prices and availability are subject to change without notice.

Materials: Due to the fact that the majority of our material are natural or handmade, colors may vary and dimensions are approximate.  Growing patterns vary around the world and therefore we cannot guarantee color matches.  All bamboo will split to some degree.

Payments:  All orders must be prepaid prior to shipping.  Orders paid by check need to be received and clear the bank before goods will be shipped.  We accept MasterCard, VISA, American Express and PayPal Payments.

Returned Checks:  a $40.00 fee will be charged for any checks returned to our bank.

Shipping Policy:  Freight charges are quoted from our depots to the customer’s destination. A small packing fee is added to the freight charge and is passed on to the customer’s account.  Orders under 8ft and 150lbs can ship via FedEx, UPS or DHL.  Larger orders will ship via a common carrier with which we have a discount program.  Customers may use their own freight companies for Winter Garden collections, or they may take advantage of our discounted rates.  Freight quotes are valid for 30 days due to the fluctuating gas prices.  Please see our Shipping Policy Procedure for more details.

Freight Claims:  All shipment deliveries (including concealed goods) are the customer’s responsibility to check for losses, damages, or shortages before the driver departs.  Claims need to be clearly noted on the driver’s delivery note or bill of lading.  Do not throw away and damaged packaging until the shipment has been inspected and claim settled with the freight company.  In order for you to receive any compensation due to losses or damages, claims must be reported to Tiki’s By Design, Inc. within 5 days of receipt, so that a claim can be filed with the freight company.  If the product arrives completely unusable, please refuse delivery.  Please see our Freight Delivery Policy Procedure for more details.

Returns:  Products can only be returned with a 30 day period from purchase and only once a Return Number has been authorized by Tiki’s By Design, Inc.  Please mark all packages with the Return Number.  A 20% Restocking Fee will be charged if the goods are received in an unaltered condition.  Return shipping is the responsibility of the customer, unless the incorrect product was shipped by Tiki’s By Design, Inc.  Custom manufactured products and any altered products cannot be returned.  Please see our Return Policy Procedure for more details.

Cutting and Splitting to Length:  We charge $1.00 per cut when cutting poles to length.  We charge $1.25 per Linear Foot when splitting poles lengthwise.  For diameters over 4”, we charge $1.75 per Linear Foot.

Fire Safety:  Most of our products can be pre-fire retardant, not fire proofed.  It is the customer’s responsibility to ensure the approval of the local Fire Marshall before installation of our products.  If the products are pre-fire retardant by Tiki’s By Design, Inc. before shipping, or applied on site by Tiki’s By Design, Inc. we will issue a Fire Marshall Approved Certification of Application.  Fire Retardants can be purchased directly from Tiki’s By Design, Inc. and applied by the customer, using the manufacturers’ recommendations.  Tiki’s By Design, Inc. cannot issue a certificate for this option.

Product Merchantability:  All goods are sold according to the following limitations of warranties:  The express limited warranty is exclusive and in lieu of all other warranties expressed or implied, including, but not limited to, any warranties of merchantability or fitness for a particular purpose.  There are no warranties which extend beyond the description of the products sold except as expressly set forth herein.  This disclaimer and exclusion of warranties shall survive the expiration of the limited warranty.  The remedies of owner for any specifically provided herein and owner hereby waives any and all other claims, actions, and demands.  As we cannot anticipate all conditions under which this information and our products, or the products of other manufacturers in combination with our products may be used, we accept no responsibility for the results obtained by the use of this information or products, or the safety, and suitability of our products, wither alone or in conjunction with other products.  Users are advised to make their own tests to determine the safety and suitability of each such products or product combination for their own purposes.  We sell the products without guarantee or warrantee, and buyers and users assume all responsibility and liability for loss or damage arising from the handling or use of our products whether used alone or in conjunction with other products.  Tiki’s By Design, Inc. shall not be liable in any case for any damage, however incurred to buildings, property or the contents thereof, nor will it be responsible for special, incidental, consequential or penal damages.
